Welcome to unionhillsgolfclub.com (the “Site”), operated by Union Hills Golf Club (“Union Hills,” “we,” “us” or “our”). By using the Site, booking a tee time, or making a purchase through the Site, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the Site.
Use of the Site
You may use the Site for lawful, personal purposes such as learning about the course, booking tee times and contacting us. You agree not to:
- Use the Site in any way that violates applicable laws or regulations.
- Make speculative, false or fraudulent bookings or purchases.
- Use bots, scrapers or other automated tools to access the Site or booking system, or to reserve tee times.
- Attempt to interfere with, disrupt or gain unauthorized access to the Site, its servers or related systems.
- Submit content through our forms that is unlawful, abusive, misleading or that infringes anyone’s rights.
Tee times and online booking
- Booking platform: online tee time reservations and golf shop purchases are processed through a third-party booking provider. Your use of that platform is also subject to its terms and policies.
- Dynamic pricing: Union Hills uses dynamic pricing. Rates vary by date, time, demand and other factors and may change at any time until a booking is confirmed. The rate shown at checkout is the rate for that booking.
- Fees: rates may be subject to additional fees, such as a Water Resource Fee (WRF), as shown on the Site or during checkout.
- Cancellations, no-shows and rain checks: bookings are subject to the cancellation, no-show and weather policies shown at the time of booking or posted by the golf shop. Please call the golf shop with questions before you book.
- Course policies: all players must follow course rules, including pace of play, dress code, cart rules and instructions from staff. We may refuse service or remove anyone who does not follow course policies.
Swing First Golf Card, gift cards and promotions
The Swing First Golf Card, specials, daily deals and other promotions are subject to their own terms, eligibility rules, blackout dates and expiration dates as stated at the time of purchase or in the offer. Promotions cannot be combined unless stated, have no cash value unless required by law, and may be changed or ended at any time.
Events, outings and tickets
Event registrations, group outings and ticket purchases are subject to the details, deadlines and refund policies listed for each event or agreed in writing with our staff. Events may be rescheduled or canceled due to weather, course conditions or other circumstances.
Pricing and information accuracy
We work to keep the information on the Site accurate and current, but course conditions, hours, rates, menus, availability and other details can change without notice. If a price or detail is listed in error, we may correct it and cancel any affected booking or order, with a refund of any amount paid.
Intellectual property
The Site and its content, including text, photos, graphics, logos and the Union Hills name and owl logo, are owned by or licensed to Union Hills and are protected by copyright, trademark and other laws. You may not copy, reproduce, distribute or use Site content for commercial purposes without our written permission.
Third-party links and services
The Site links to third-party websites and services, such as our booking provider, mobile app stores and social media. We do not control and are not responsible for their content, policies or practices. Your use of those services is at your own risk and subject to their terms.
Privacy
Our Privacy Policy explains how we collect and use information when you use the Site, and is part of these Terms.
Disclaimers
The Site is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Site or booking system will be uninterrupted, error-free or free of viruses or other harmful components.
Limitation of liability
To the fullest extent permitted by law, Union Hills and its owners, operators, managers, employees and affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or booking system. Our total liability for any claim related to the Site will not exceed the amount you paid us for the booking or purchase that gave rise to the claim.
Indemnification
You agree to indemnify and hold harmless Union Hills and its owners, operators, managers, employees and affiliates from any claims, damages or expenses arising from your misuse of the Site or your violation of these Terms.
Governing law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules. Any dispute related to these Terms or the Site will be brought in the state or federal courts located in Maricopa County, Arizona.
Changes to these Terms
We may update these Terms from time to time. When we do, we will change the effective date above. Your continued use of the Site after an update means you accept the revised Terms.
